Die Beteiligung des Nationalen Normenkontrollrats erfolgte mit Fristsetzung von einem
Arbeitstag. Diese Form der Beteiligung entspricht in keiner Weise den Anforderungen der
GGO. Fristsetzungen dieser Art schränken die Prüfrechte des Normenkontrollrats ein und
erschweren eine substantielle Auseinandersetzung mit dem Regelungsvorhaben in
unzumutbarer Weise.
Dem Ressort ist zu Gute zu halten, dass es die Änderungen des Erfüllungsaufwands für
die Verwaltung weitgehend nachvollziehbar dargestellt hat. Die Aufwände für die
Wirtschaft wurden allerdings nicht quantifiziert. Das Ressort hat jedoch eine
Nacherfassung vor Abschluss des parlamentarischen Verfahrens im Bundestag zugesagt.
Der Nationale Normenkontrollrat macht im Rahmen seines gesetzlichen Auftrags daher
insgesamt keine Einwände gegen die Darstellungen der Gesetzesfolgen im vorliegenden
Regelungsvorhaben geltend.
